Terms & Conditions

The rules for booking, hosting and travelling with NearbyEscape, written to be clear and fair to travellers and hosts.

Last updated 26 October 2026

1. About these terms

These Terms & Conditions govern your use of the NearbyEscape website, apps and services. By creating an account, browsing or making a booking, you agree to these terms, our Privacy Policy and the policies shown to you during checkout.

If you do not agree with these terms, please do not use NearbyEscape.

2. Our role as a marketplace

NearbyEscape is a travel marketplace for Northeast India. Stays and events are listed and operated by independent, KYC-verified hosts and event managers. Experiences, tour packages and car rentals are curated by NearbyEscape and may be delivered together with local partners.

Every host-managed listing is reviewed by our team before it goes live. Hosts and operators remain responsible for delivering the service described in their listing.

3. Accounts and eligibility

You must be at least 18 years old to create an account and make bookings. Travellers under 18 must be booked by a parent or guardian.

You can sign in with a one-time password (OTP) sent to your mobile number or with Google, where these options are enabled. Keep your phone and email secure: you are responsible for activity on your account.

  • Provide accurate personal and traveller details.
  • Do not share OTPs with anyone, including people claiming to be from NearbyEscape.
  • Tell us promptly if you suspect unauthorised use of your account.

4. Bookings

A booking is confirmed only when payment succeeds and you receive a booking number on screen and in your account. Availability, prices and room capacity are checked again at checkout.

Traveller names and counts must match the people who will use the booking. Hosts may ask for a valid government photo ID at check-in or entry.

5. Prices, taxes and payments

Prices are shown in Indian Rupees (INR). Before you pay, checkout shows the full price breakdown, including applicable GST, platform fees, discounts and any wallet credits applied.

Payments are processed by our licensed payment partners. NearbyEscape does not store your full card, UPI PIN or net-banking credentials. Invoices are available in your account after a successful booking.

6. Wallet credits

Your NearbyEscape wallet may hold refund credits, cashback and reward credits. Promotional credits are subject to the offer terms shown when they are issued, are non-transferable and cannot be withdrawn as cash unless the law requires otherwise.

Where wallet payments are enabled, you can apply eligible credits at checkout. Every wallet credit and debit is recorded in your wallet history.

7. Cancellations and refunds

Each listing shows its cancellation terms before you pay. Cancellations and refunds follow those terms and our Cancellation and Refund policies. Where options are offered, you can choose to receive an eligible refund to your original payment method or to your NearbyEscape wallet.

If a host or operator cancels a confirmed booking, we will help you find an alternative or refund the amount you paid for it.

8. Event tickets

Event bookings include QR tickets in your account. Each QR code is checked at entry, and a code that has already been used cannot be used again. Do not share or post your QR code publicly.

The event manager runs the event and is responsible for the venue, schedule and entry rules shown on the event page.

9. Hosts and event managers

Hosts must complete KYC (identity, address and bank details, and GST details where applicable) before listing or receiving bookings. Listings must be accurate, kept up to date and approved by our team before they go live.

Hosts must hold the licences, registrations and permissions their property or event requires. Earnings are credited to the host wallet and paid out to the verified bank account under our payout terms.

10. Traveller responsibilities

Some parts of Northeast India require an Inner Line Permit (ILP) or Protected Area Permit (PAP). You are responsible for getting the permits, IDs and travel documents your trip needs.

  • Follow house rules, venue rules and local laws.
  • Respect local communities, customs and the natural environment.
  • Pay for any damage you cause during your stay or rental.

11. Reviews and content

Reviews must be honest and based on your own experience. We may moderate or remove content that is abusive, misleading, unlawful or unrelated to the booking. By posting content you allow NearbyEscape to display it on the platform.

12. Prohibited use

You must not:

  • Make fraudulent bookings or payments, or misuse refunds or promotions.
  • Scrape, copy or resell listings or content without written permission.
  • Interfere with the security or normal operation of the platform.
  • Contact hosts or travellers to arrange payments outside NearbyEscape.

13. Limitation of liability

To the extent permitted by law, NearbyEscape is not liable for indirect or consequential losses, or for events beyond our reasonable control such as weather, landslides, road closures or government restrictions. Nothing in these terms limits rights you have under the Consumer Protection Act, 2019 or other applicable law.

14. Suspension and termination

We may suspend or close accounts that break these terms, put other users at risk or are needed to comply with the law. You can ask us to close your account at any time. Confirmed bookings and legal record-keeping obligations may continue after closure.

15. Governing law

These terms are governed by the laws of India. Disputes are subject to the jurisdiction of the competent courts in India.

16. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they last changed. Continuing to use NearbyEscape after an update means you accept the revised terms.

17. Grievances and contact

In line with the Information Technology Act, 2000 and the rules made under it, you can raise a complaint or grievance through our Contact page or Help Center. We acknowledge complaints promptly and resolve them within the timelines the law requires.
